Motorcycle Helmet Requirements in Texas

If you ride a motorcycle in Texas, the helmet rule isn’t “always” or “never.” It depends on your age — and if you’re 21 or older, it depends on whether you qualify for one of Texas’ two legal exceptions.

Texas Helmet Law: The Simple Rule

Riders and passengers under 21

If you’re under 21, Texas law says you must wear a helmet — no loopholes, no exceptions.
That applies to:

  • the operator (rider)

  • the passenger

  • any bike, any trip, any time

Riders and passengers 21 and over

If you’re 21+, you can ride without a helmet only if you meet one of these conditions:

  1. You completed a state-approved motorcycle safety course
    OR

  2. You have at least $10,000 in medical insurance that covers motorcycle-related injuries

If you don’t meet at least one of those, then the law treats you like everyone else: helmet required.

What Counts as “Qualifying” to Ride Without a Helmet?

Option A: Safety Course

Texas allows helmet-free riding at 21+ if you’ve completed a state-approved motorcycle safety course. If you’re stopped, be ready to show proof.

Option B: Medical Insurance

The other option is having $10,000+ in medical insurance coverage that applies to motorcycle injuries. This is about medical coverage — not whether you have basic liability insurance on the bike.

What Happens If You Don’t Follow the Helmet Law?

Helmet violations can mean a ticket. But the bigger danger isn’t the citation — it’s what happens after a crash.

If someone hits you, insurance companies immediately look for anything to use against you. No helmet? They’ll try to turn that into:

  • “You caused your injuries”

  • “You should get less money”

  • “Your pain and suffering isn’t worth as much”
